A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.

The case stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer alien smuggling allegations, he was detained in federal custody.

In her decision, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
